Website Ownership & Service Agreement

Draft terms — subject to final legal review; not yet effective

Proposed terms for owner and qualified attorney review. No checkout, recurring billing, signature or existing-customer conversion is authorized. Final project-specific scope and transfer feasibility must also be approved.

1. Scope, content & revisions

The standard build covers up to 5 mobile-friendly pages, a contact form and basic local SEO setup (not ongoing SEO). The project schedule must list the pages, deliverables, platform, account owners, technical dependencies and available export formats before work begins.

The customer supplies accurate business details, lawful text, logos and photos, permissions to use materials, account access and timely feedback. Two consolidated pre-launch revision rounds within the agreed scope are included. New pages, redesigns, custom features, copywriting beyond agreed scope and additional revisions need a separate approved quote. Launch timing depends on readiness and approval; no guaranteed deadline.

  • Up to 5 mobile-friendly pages & a contact form
  • Basic local SEO setup — not ongoing SEO
  • 2 pre-launch revision rounds within agreed scope
  • Hosting, SSL & routine backups during the 12-payment term
  • Routine security monitoring & technical updates
  • Monthly website health check & care summary
  • 2 minor content edits/month, up to 15 minutes each; no rollover

2. Plans & payment dates

Payment Plan: $600 to start + $600 at launch, or $300/month × 4. Pay in Full: $1,200 one-time. Most Popular: first $150 payment to start, then $150/month for 11 more payments — 12 payments totaling $1,800.

For the split plan, $600 is due at the agreed start and $600 at approved launch. Alternatively, four $300 payments fall on the dates recorded in the final project schedule. For ownership, twelve $150 monthly due dates, including the first payment date, must be agreed and written down before service starts. The monthly ownership offer requires the first $150 payment to start and has a 12-payment commitment; it includes term care and is not a free website.

No new payment collection, recurring charge, checkout or authorization is enabled by this draft. Domain renewals, premium/aftermarket domains, third-party subscriptions and approved out-of-scope work are separately disclosed before agreement. Existing customers remain under their existing agreements; no automatic conversion.

3. Late payments: notice & cure

Proposed protection: written late-payment notice and a 10-calendar-day grace period to cure after that notice before payment-related suspension. Any suspension must be proportionate, communicated in advance and distinguish service access from ownership. No arbitrary deletion of a website or customer data for a late payment.

Notice delivery, lawful suspension, backup retention, restoration, billing during suspension and recovery procedures require owner and attorney approval. This draft adds no late fee, automatic forfeiture or irreversible deletion policy.

4. Early cancellation & optional ownership buyout

Request early cancellation in writing. Cancellation alone does not transfer unfinished or unpaid custom work. The optional ownership buyout is max($0, $1,200 minus amounts paid under the ownership plan). After four payments ($600), it is $600; after eight payments ($1,200), it is $0. The buyout is not the remaining balance of the $1,800 term.

A $0 calculated buyout can occur before payment 12 and allows eligible early transfer; it does not silently authorize continued care. At an early exit, document the completion status, amounts paid, services actually earned/delivered and any agreed continuation. Any refund, credit or remaining service obligation requires final legal review; do not double-charge earned services or misrepresent a cancellation penalty as a buyout. No additional cancellation penalty is authorized by this draft.

5. Your domain, from day one

The domain is registered in the customer's own registrar account from day one, with the customer as owner and in control of renewal and recovery. The agency receives delegated DNS access only. Initial registration of one standard available domain is included within a reasonable standard cost agreed before purchase. Premium/aftermarket domains and renewals are separate.

Existing domains remain in the customer's account. DNS assistance does not transfer the domain to the agency; delegated access can be revoked after a coordinated handoff.

6. Ownership is not hosting

After the project is completed and the chosen build is fully paid, twelve ownership payments are completed, or an eligible early buyout is completed, ownership of the agreed custom transferable work passes to the customer. Customer-supplied content remains the customer's throughout, subject to the customer's existing rights.

Transferable deliverables may include agreed custom design/code and content exports where the platform and rights permit. Third-party software/licenses, fonts or stock assets with non-transferable licenses, non-transferable assets, pre-existing agency tools, shared hosting accounts and integration services are excluded. Identify exclusions and any ongoing usage license in the final project inventory before signing.

A website can be owned while still requiring paid hosting, a database, storage, form/email services, credentials and third-party subscriptions to operate. Account transfer and export capabilities vary. No unconditional full-source, infrastructure or integration portability is promised.

7. Export, migration & cooperation

Upon an eligible written export/migration request after completion/payment or buyout, provide the basic available export and dependency notes within 10 business days. Basic export is included. Complex migrations, rebuilding unsupported functions or replacement integrations are separately scoped and quoted before work.

Reasonably cooperate with the customer's chosen provider and identify missing access, license limits and technical dependencies promptly. Export customer-owned records only with appropriate authority; never include unrelated customers' data, agency credentials or private keys. Share access securely. Coordinate DNS only after the replacement hosting, forms, data and integrations are checked.

Before signing, confirm the actual site's source access, database/content and media export formats, form/notification delivery, account ownership, third-party license rights and replacement hosting. The agency website's architecture does not establish any individual client's portability.

8. Term care & optional post-term care

During the twelve-payment ownership term, care includes hosting/SSL, routine backups, routine security monitoring and technical updates, monthly health checks, two minor content edits per month up to 15 minutes each (non-rollover), and a monthly care summary. A minor edit means changing text or replacing an image on an existing page, not new design, pages, features or integrations.

After your twelfth payment, the $150 billing ends and the agreed deliverables are yours. You can continue with a separately agreed paid hosting and maintenance plan, or move your website elsewhere. Nothing renews or charges automatically.

Post-term hosting and maintenance is a separate paid plan agreed in writing before the term ends; its scope and price are not set by this draft. Any post-term plan requires separate explicit authorization before any charge, is month-to-month unless otherwise agreed, and can be cancelled by written request before the next renewal, with no new renewal charges after cancellation takes effect. Coordinate export and alternative hosting before service ends. Refund/proration and notice mechanics require legal review.

The existing higher-support Website Care plan is separate (currently advertised at $150/month with up to 2 hours of minor edits). It is neither the ownership plan nor any post-term plan. Existing contracts, including any legacy $149 arrangements, are not changed.

9. Service limitations

Basic local SEO is initial page structure, relevant titles/headings and on-page setup, not ongoing SEO management. No guaranteed rankings, traffic, leads, sales, uninterrupted uptime or immunity from security incidents. Routine updates, backups and support are limited to compatible authorized systems; restoration, emergency response, major repairs, new features and store operations require specific scope.

Before approval, the project schedule must define backup cadence/retention, monitoring coverage, update compatibility, support contact and response expectations. No service-level guarantee or unlimited edit promise is created by this draft.

10. Reserved for attorney review & final acceptance

Approval/acceptance: owner and a qualified attorney must review the final agreement and project schedule before it becomes effective. An inquiry or plan preference is not acceptance, a signature or payment authorization. Prepare any final signing/consent process only after review; this draft cannot be accepted through a payment flow.

Liability, remedies, warranties and allocation of risk: attorney review required. No liability cap, binding waiver, indemnity or legal enforceability assurance is invented here.

Confidentiality, privacy and data handling: attorney review required for authorized access, permitted purposes, vendors, security responsibilities, retention/deletion, customer data export, incident procedures and any needed data-processing terms. Do not promise absolute confidentiality or security.

Disputes, governing law, venue and resolution procedure: attorney review required. No arbitration requirement, jurisdiction or binding dispute waiver is chosen by this draft.

Ownership & care questions

What is the $150 website plan?

One affordable plan: your first $150 payment starts the project, followed by 11 more monthly payments of $150 — 12 payments totaling $1,800. It includes up to 5 mobile-friendly pages, a contact form, basic local SEO setup, and hosting, security and routine updates during the 12-month term. Two pre-launch revision rounds are included. This is not a free or unlimited-service offer.

How much will I pay in total?

12 payments of $150 total $1,800. The same standard build is also available at $1,200 paid in full, split $600 to start + $600 at launch, or $300/month for 4 months. Larger scope and third-party fees require separate agreement.

When do I own my website?

Ownership of the agreed deliverables transfers only after all 12 payments are completed, or an eligible early ownership buyout — never on day one. Your own content remains yours, and your domain is in your own account from day one. Owning the website does not mean owning the hosting platform.

What happens after the twelfth payment?

After your twelfth payment, the $150 billing ends and the agreed deliverables are yours. You can continue with a separately agreed paid hosting and maintenance plan, or move your website elsewhere. Nothing renews or charges automatically.

Who owns and controls my domain?

You do, from day one: register it in your own registrar account. The agency receives delegated DNS access only, not ownership. One standard available domain’s initial registration is included within an agreed reasonable cost; premium/aftermarket domains and renewals are separate.

Can I cancel early or buy out ownership?

Request cancellation in writing; early cancellation alone does not transfer unfinished or unpaid custom work. The optional ownership buyout is max($0, $1,200 minus amounts paid under the ownership plan). For example, after 4 payments ($600), the buyout is $600; after 8 payments ($1,200), it is $0. Earned services, unfinished work and any refund/credit treatment must be documented without double charging or misleading penalties, and remain subject to attorney review.

What happens if a payment is late?

The proposed terms allow 10 calendar days to cure after written late-payment notice, before payment-related suspension. No arbitrary website deletion. Notice, proportionate suspension and any retention/recovery procedure need final legal review.

What transfers, and what does not?

The agreed deliverables — your content and the custom transferable design and code — transfer where rights and the chosen platform permit. Third-party licensed assets, domains, subscriptions, agency tools, shared hosting accounts and integration services are excluded unless separately agreed. Source, data exports, form delivery and integrations must be checked for your actual site; continued operation may require new hosting, credentials or replacement services.

What edits and SEO are included?

During the 12-month term: two minor content edits per month, up to 15 minutes each, with no rollover, plus a monthly care summary. Minor edits are text or image replacements on existing pages, not new pages, redesigns or new features. SEO is basic local setup only, not ongoing SEO or guaranteed rankings.

How do I leave or move my website?

Request an export/migration in writing. When completion/payment or buyout eligibility is met, the basic available export and dependency notes are included within 10 business days. We reasonably cooperate with your new provider; complex migrations are separately quoted. Confirm hosting, forms, data and integrations before switching DNS. If you want post-term hosting and maintenance, it is a separate paid plan agreed in writing — never automatic.
